Daphne sends bulkhead, pier and bluff questions to Environmental Programs. It requires copies of the Corps, ADEM and State Lands permits to be filed before the structure goes in. Creeks and steep slopes add their own rules.

Daphne's bayfront, creeks and bluffs: the local rules
Daphne writes its coastal rules out in detail, so the steps are clear. A contractor who skips the city's order of filing can lose weeks.
Which Daphne office handles a pier or bulkhead permit?
Building Inspection issues the building permit. For piers, bulkheads, wetlands or any sensitive area, its own page tells you to contact Environmental Programs. Daphne Building Inspection page That office is at 1705 Main Street, and the number is (251) 620-1700. Daphne Environmental Programs page
- A general building permit needs a plot plan, full drawings, the contract with its job cost and the contractor's Daphne business license. Daphne permit checklist
- Inspections are requested by email and are done within 48 business hours. Daphne Building Inspection page
The coastal rules are in Article 20 of the Land Use and Development Ordinance. They apply below 10 feet above mean sea level, and a development permit is required there.
Applications need an erosion control plan attached. Daphne LUDO Article 20 Reviewing falls to the Environmental Programs Manager, who tells you which state and federal permits you also need, and posts public notice of the permit. Daphne LUDO Secs. 20-14 and 20-15
Why does Daphne ask for copies of your other permits?
Daphne's article names the Corps and ADEM as the regulators of work in federal waters, and State Lands as the regulator of piers on state bottoms. It then requires a copy of each applicable permit to reach the city before the structure is installed. Daphne LUDO Sec. 20-18(b)
That rule sets a practical order of work.
- Send the Corps request through its online system, and give ADEM and State Lands copies. Corps Mobile District ADEM Form 166
- Give State Lands its notice of intent for any pier or other improvement on state bottoms. Daphne LUDO Sec. 20-18(b)
- Hand the city a copy of each approval.
- Only then schedule pile driving.
Daphne also defines its terms. A residential dock or pier is one built next to a residential lot for free private use or mooring. Submerged lands are those below the mean low waterline or covered by the mean high waterline. Daphne LUDO Article 8
The Alabama permit guide covers the state filings in more detail, and the bulkhead replacement page explains the build itself.
How do the slope, flood and creek rules apply?
Daphne treats a bluff lot differently from a flat lot. A steep slope is any slope above 30 percent along a coastal bluff or ravine. The city also treats any repair or rebuild that costs half a structure's value or more as a substantial improvement. Daphne LUDO Sec. 20-6
- Steep bluff and ravine slopes need a 40 foot setback in new subdivisions and on commercial sites. Daphne LUDO Sec. 20-18(d)
- Streams get a 50 foot vegetated buffer on both sides, and wetlands get 30 feet. Daphne LUDO Sec. 18-3(d)
- In a mapped flood zone, written approval from the Flood Plain Administrator comes before a site disturbance permit. Daphne LUDO Article 11
- The regulatory elevation is the base flood plus one foot, and fill that blocks flow or speeds erosion is barred. Daphne LUDO Article 11
Small jobs get watched, too. The city holds a stormwater permit for its storm sewer system and has a construction best management practices ordinance, 2014-14. Daphne stormwater plan Expect inspectors to look at silt fence on any creek or bluff lot.
What is the shore like from Village Point to Yancey Branch?
Parts of this shore are still soft and natural. The 2009 survey of the Jordan Brook to Yancey Branch reach found 13,888 natural feet in a 17,273 foot shoreline, with just 2,624 feet of bulkhead. MBNEP Eastern Shore plan ADEM makes applicants rule out non-structural options first, so a new wall on this reach needs a strong case. ADEM rule 335-8-2-.06
The estuary program also mapped sand and marsh gain at Bay Front Park and Village Point since the 1950s. MBNEP Eastern Shore plan Eleven recorded archaeological sites are tied to The Village, including Jackson's Oak at Village Point, so report any odd finds during digging. MBNEP Eastern Shore plan
Water quality draws attention too. Yancey Branch's soil load is 798 tons per square mile each year, against a natural rate of 64. MBNEP Eastern Shore plan Sea grass survives mainly in lower D'Olive Bay and off the Jordan Brook shore, which makes the state's grass bed rules a real factor. MBNEP Eastern Shore plan
What should Lake Forest and D'Olive Creek owners know?
Lake Forest was built after the land was bought for a subdivision when I-10 stalled at the bay. Building began around 1971, and erosion and silt have plagued the creeks, Lake Forest Lake and the bay since the 1970s. MBNEP D'Olive Creek page
- The city says the watershed shifted from farms and forest to homes and shops over 40 years, which sped up stormwater. It has worked with the estuary program on D'Olive Creek, Tiawasee Creek and Joe's Branch. City of Daphne
- The estuary program's own brochure says restoration began in 2012. It counts about 14,898 feet of stream restored and about $16.2 million in project costs. MBNEP restoration brochure
The D'Olive Bay ramp at 1 Yacht Club Drive has two ramps and about 20 parking spaces, a handy staging point. ADCNR boating access list The Spanish Fort shore of the bay is covered in Spanish Fort and D'Olive Bay.
Which public projects and storms matter on the bayfront?
The city shut Bayfront Park on October 27, 2025 to build a $15 million amphitheater. A $7.2 million state grant helps pay, and completion is expected in spring 2027. City of Daphne A 2026 state list adds $5 million for a Jubilee fishing pier at the same park. Fox 10
Jubilees, when fish crowd the shallows before dawn, happen only in summer. They are most common from Great Point Clear to just north of Daphne. Alabama Cooperative Extension
- Ivan dropped 7.5 inches of rain at Daphne in 2004. National Weather Service Mobile
- The city has 132 federal flood claims worth $2.5 million. OpenFEMA claims data
Read the storm guide and the flood zone guide before setting cap height. Bluff owners to the south should read Fairhope, Montrose and Ecor Rouge, and county-wide rules are on the Baldwin County page.
What could the work cost?
In Daphne, permit order affects schedule as much as price. A job that waits on the Corps, ADEM or State Lands copies before the city will release a permit costs more in idle equipment time. Ask bidders who files each piece and who pays the fees.
Prices below are published figures, not a quote for your wall. Local figures come from Baldwin County bid tables and a 2014 Mobile Bay guide. National guides and contractor pages fill the gaps, and each row says which one it is.
